The E-2 Treaty Investor Visa allows nationals of countries that maintain treaties of commerce and navigation or bilateral investment agreements with the United States to invest in U.S. businesses. To be eligible, applicants must make a substantial financial investment in a U.S. enterprise and play an active role in its management. Although it is a non-immigrant visa, it can be renewed indefinitely as long as the investment and business operations continue to meet the visa’s requirements.

In addition, the E-2 visa covers the investor’s immediate family, including their spouse and unmarried children under the age of 21. The spouse is eligible to apply for work authorization, enabling them to work legally in the U.S. To qualify for the visa, applicants must demonstrate that their investment is substantial enough to support the successful operation of the business and that they maintain control over the invested funds. The enterprise must also produce sufficient income to support the investor and their family or contribute significantly to the U.S. economy. Ultimately, the E-2 visa fosters economic growth and reinforces international partnerships through foreign investment.
